Do Matheo search the new propietary of a patent |
|
Hello
I have a question about transfer of patents and MAtheo search system.
An example:
If company A shells patents to the company B.
When you do a search in Matheo about the "Aplicant" B.
The results will show the patents of the company B or show the patents of A and B?
Thanks |

Hi Garde, good and complex question.
A patent selling agreement or any other kind of patent agreement between two companies, A and B, are *private* agreements.
If they like it can remain even secret or not disclosed to the public. Also it can be public but not registered in the corresponding patent office. Finally, they can register this private agreement in the corresponding patent office. So (even if there is an official agreement) the patent records can remain without any change in the patent record.
As far as I know -in case of EP patents and in case of Espacenet- the ownership changements can appear as a legal issue in the "Inpadoc" tab (legal status), but not in the applicant field of the patent record.
If you suspect that a patent from Company A has been sold to Company B, Espacenet don't permit to search in the contents of the legal status. Here Matheo Patent can be really very useful.
We open a project and download all the patents from Company A. Then it's possible to use the "Local Search Engine" with the expression [legal/"Company B"]. In this way we will find any kind of legal issues between company A and Company B, especially oppositions made by Company B but also change of ownerships from A to B.
I hope I have clarified your question.

Hello
I make a search of a patent of one owner who had transfered his patents to anoter company.
And yes I found it in this search and in another search with the actual owner, in both I find results.
As you say I have to download the impadoc data to see the legal status of transfer the property of patent.
I think it only works in the cases of the transferring its made public at the patent office, no in the private contracts.
Gracias Juan Carlos |
